IP in Deeptech – Protecting Innovations in Practice: Event Summary

On April 16, 2025, we had the pleasure of hosting Tomasz Szambelan, Advocate, Senior Associate at Kochański & Partners, an intellectual property law expert, who shared valuable insights on innovation protection in the DeepTech sector.

During the lecture “IP in Deeptech – protecting innovations smartly,” participants explored fascinating aspects of intellectual property rights, with particular emphasis on the needs of startups and technology companies. The lecture provided key information for innovators and entrepreneurs.

Key topics discussed during the conference:

IP 360

The speaker presented a comprehensive overview of available forms of intellectual property protection, specifically targeted at startups and technology companies. Mr. Szambelan thoroughly discussed the strategic approach to securing innovations at every stage of product and business development.

Patent or trade secret?

This question proved fundamental for companies operating in artificial intelligence, biotechnology, and quantum technologies. The expert emphasized that the choice between a patent and a trade secret depends on the nature of the innovation, the risk of information leaks, and commercialization prospects. The advantages and disadvantages of each solution were analyzed in detail across various technology sectors.

Brand protection in future technologies

This topic emerged as one of the most crucial aspects of intellectual property. The presentation examined case studies of companies that successfully secured their trademarks, as well as those that fell into legal pitfalls. Mr. Szambelan presented strategies for effective brand protection in a rapidly changing technological environment.

Who owns IP generated by AI?

In this section, lawyers and technologists presented various perspectives—ranging from the position that rights should belong to the creator of the algorithm to opinions advocating for new regulations tailored to AI’s increasing role in innovation. The discussion covered current legal challenges and potential legislative solutions in this dynamically developing field.

The biggest startup mistakes in intellectual property

This part of the lecture served as a warning for young companies and innovators. The speaker discussed cases of businesses that lost their competitive edge or faced costly lawsuits due to inadequate IP protection. The key takeaway was the importance of implementing an IP protection strategy at the early stages of product development.

The conference provided participants with not only theoretical knowledge but, above all, practical guidance and inspiration for managing intellectual property wisely in the era of new technologies. Many questions remained open and will undoubtedly be the subject of future debates and legal regulations.
